4.2 Due Diligence

You are responsible for conducting your own due diligence before making any investment decisions. This includes verifying property details, developer credentials, legal status, and financial viability. We recommend consulting with qualified legal, financial, and real estate professionals.

5. Property Listings and Information

Property information is provided by developers and third parties. While we strive for accuracy, we do not guarantee the completeness, accuracy, or timeliness of listings. Prices, availability, and specifications are subject to change without notice. Always verify information directly with developers.

6. Financial Transactions

All financial transactions for property purchases are conducted directly between you and the property developer or their authorized agents. Off Plan Properties does not handle purchase funds, deposits, or payments. We are not party to purchase agreements and bear no responsibility for transaction completion or disputes.

7. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is owned by Off Plan Properties or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES REGARDING PROPERTY LISTINGS, INVESTMENT RETURNS, OR TRANSACTION OUTCOMES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFF PLAN PROPERTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUE, OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF THE PLATFORM OR ANY PROPERTY TRANSACTION.

10. Indemnification

You agree to indemnify and hold harmless Off Plan Properties, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, for violation of these Terms or any other reason at our sole discretion.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved through binding arbitration in Dubai, UAE, in accordance with the DIFC-LCIA Arbitration Rules.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified through the Platform or via email. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
